OACTA Amicus Brief Filed in Tort Reform Challenge OACTA is pleased to announce the filing on December 18, 2006 of its most significant Ohio Supreme Court amicus brief in recent years. The suit, Arbino v. Johnson & Johnson, challenges the constitutionality of the landmark tort reform legislation enacted in 2005 under SB 80. OACTAs amicus brief was authored by J. Huebert at Porter Wright in collaboration with Ron Rispo and Dan Richards at Weston Hurd, and in coordination with Johnson & Johnsons counsel (OACTA members Irene Keyse-Walker & Ben Sasse at Tucker Ellis) and numerous other amici. Our brief specifically addresses the statutes affecting the collateral source rule and punitive damages (caps and bifurcation).
